Cafe420 Membership Terms & Conditions

1. Introduction
1.1 These Membership Terms and Conditions (“Agreement”) govern the relationship between Café420 (“Café420”, “we”, “us”, “our”) and any person who registers as a member (“Member”, “you”, “your”).
1.2 Café420 operates an online, members-only platform that provides access to cannabis-related products and information in accordance with the laws of the Republic of South Africa.
1.3 By registering as a Member, completing a purchase, accessing the website, or using any services offered by Café420, you agree to be legally bound by this Agreement.
2. Eligibility
2.1 Membership is strictly limited to persons who are 18 (eighteen) years or older and of full legal capacity.
2.2 Café420 reserves the right to request valid identification to verify age and identity.
2.3 Any person who does not meet these requirements must not access or use the website or services.
3. Membership and Account Registration
3.1 To become a registered Member, you must complete an online purchase and provide accurate, complete, and up-to-date personal information during checkout and/or account registration.
3.2 Upon successful registration, you will be issued unique login credentials for access to the members-only portal.
3.3 Login credentials are personal and may not be shared, transferred, or used by any other person.
3.4 You are responsible for maintaining the confidentiality of your credentials and for all activity conducted through your account.
3.5 Café420 reserves the right to suspend or terminate unverified, inactive, fraudulent, or non-compliant accounts.
4. Use of the Website
4.1 The Café420 website is a private, members-only platform.
4.2 Members may access services only after successful authentication.
4.3 Café420 may modify, suspend, restrict, or discontinue any part of the website or services at its sole discretion.
4.4 Café420 shall not be liable for any interruption or unavailability of the website, save where required by law.
5. Services
5.1 Café420 provides access to cannabis-related products, including but not limited to CBD, THC, CBG, CBN, oils, edibles, and accessories, subject to availability and legal limitations.
5.2 All products are supplied for personal use only.
5.3 Café420 does not provide medical advice. Any information supplied is for general informational purposes only and should not be relied upon as medical or professional advice.
6. Member Obligations
6.1 The Member undertakes to:
comply with all applicable South African laws and regulations;
ensure lawful possession, use, and storage of products;
not resell, trade, distribute, or commercialise any products obtained;
provide accurate and up-to-date personal information.
6.2 The Member acknowledges that misuse or unlawful use of products may result in legal consequences for which Café420 bears no responsibility.
7. Product Quality and Disclaimers
7.1 Café420 endeavours to source products from reputable suppliers adhering to industry best practices.
7.2 Café420 does not warrant any specific potency, effect, outcome, or suitability for individual use.
7.3 All products are provided “as is” and may be subject to natural variation.
8. Shipping and Delivery
8.1 Café420 delivers within South Africa using third-party courier services.
8.2 Delivery fees, timelines, and conditions will be disclosed at checkout.
8.3 Risk of loss passes to the Member upon delivery to the nominated address.
8.4 Incorrect delivery details provided by the Member may result in additional courier charges.
9. Returns and Refunds
9.1 General
9.1.1 Café420 takes reasonable steps to ensure products are accurately described, properly packaged, and delivered in good condition.
9.1.2 Due to the nature of cannabis-related and perishable products, returns and refunds are subject to strict conditions.
9.2 Delivery Errors and Transit Damage
9.2.1 Delivery-related issues (including missing items, incorrect items supplied, or visible transit damage) must be reported within 3 (three) business days of delivery.
9.2.2 Claims must be supported by reasonable evidence, including photographs where applicable.
9.2.3 Where confirmed, Café420 may replace the affected item or refund the purchase price relating to that item.
9.3 Defective Products (CPA Implied Warranty)
9.3.1 Products supplied by Café420 carry an implied warranty of quality as contemplated in section 56 of the Consumer Protection Act, 68 of 2008.
9.3.2 Defects must be reported within 6 (six) months of delivery.
9.3.3 Café420 may, subject to verification and legal limitations, repair, replace, or refund the affected product.
9.3.4 This clause does not apply where defects arise from misuse, improper storage, abuse, or unauthorised handling.
9.4 Perishable and Consumable Products (Including Edibles)
9.4.1 Certain products sold by Café420 are perishable or consumable, including cannabis edibles and ingestible products.
9.4.2 In terms of section 20(2)(c) of the Consumer Protection Act, perishable goods are not eligible for return once delivered, unless defective or incorrectly supplied.
9.4.3 Opened, partially consumed, or tampered perishable products cannot be returned for hygiene and safety reasons.
9.4.4 Refunds will not be granted based on taste preferences, subjective effects, or personal tolerance, provided the product was lawfully supplied and not defective.
9.5 Refund Processing
9.5.1 Approved refunds will be processed via the original payment method unless otherwise agreed.
9.5.2 Refunds exclude delivery fees unless required by law.
9.6 Statutory Rights
9.6.1 Nothing in this policy limits or excludes any consumer rights under the Consumer Protection Act.
10. Limitations of Liability
10.1 Use of Café420 services and products is entirely at the Member’s own risk.
10.2 Café420 shall not be liable for indirect, incidental, or consequential damages.
10.3 The Member indemnifies Café420 against claims arising from unlawful use, possession, or distribution of products.
11. Website Disclaimer
11.1 The website is provided on an “as is” and “as available” basis.
11.2 Café420 does not guarantee uninterrupted or error-free operation.
11.3 Café420 is not responsible for third-party systems, hosting, or courier failures beyond its control.
12. Privacy and Protection of Personal Information
12.1 Café420 processes personal information in accordance with the Protection of Personal Information Act 4 of 2013.
12.2 Personal information may be used for account administration, order fulfilment, legal compliance, and communication.
12.3 Café420 may disclose personal information to third-party service providers where reasonably necessary for business operations or legal compliance.
13. Termination
13.1 Café420 may suspend or terminate membership for breach of this Agreement or suspected unlawful activity.
13.2 Termination does not affect accrued rights or obligations.
14. Force Majeure
14.1 Neither party shall be liable for failure to perform due to events beyond reasonable control, including acts of God, government action, or system failures.
15. Changes to these Terms
15.1 Café420 reserves the right to amend these Terms at any time.
15.2 Continued use of the website after changes constitutes acceptance of the updated Terms.
16. Governing Law and Jurisdiction
16.1 This Agreement is governed by the laws of the Republic of South Africa.
16.2 The parties consent to the jurisdiction of South African courts.
17. General
17.1 This Agreement constitutes the entire agreement between the parties.
17.2 If any provision is held invalid or unenforceable, the remaining provisions remain in force.
